These Terms and Conditions govern your use of the SALEM&CO. website and your purchase of products from us.

Throughout these Terms, “Salem&Co,” “we,” “us,” and “our” refer to MAHMUT SALIM, trading as SALEM&CO. By accessing our website or placing an order, you agree to these Terms.

Nothing in these Terms limits any consumer rights that cannot legally be excluded under the laws applicable to you.

1. Our Store

Salem&Co operates an online jewelry store through Shopify. Our website, products, content, customer accounts, checkout features, and related services are collectively referred to as the “Services.”

To make a purchase, you must be legally capable of entering into a binding contract or have permission from a parent or legal guardian.

2. Products and Product Information

We make reasonable efforts to describe and display our products accurately, including their materials, dimensions, finishes, colors, and design details.

Because some products may be handmade, engraved, plated, polished, or produced using natural or individually finished materials, slight differences may occur between products. These variations are not normally considered defects.

Product colors may also appear differently depending on your screen, lighting, or device settings.

Measurements, photographs, weights, and other product information are approximate unless specifically stated otherwise.

3. Jewelry Materials and Care

Product materials are stated on the relevant product page. Customers are responsible for reviewing the product description before purchasing.

Jewelry may naturally show signs of wear over time. Plating, oxidation, polishing, gemstones, rubber components, chains, and surface finishes may change depending on use, storage, exposure to moisture, chemicals, perfumes, cosmetics, or cleaning products.

Care instructions should be followed to preserve the appearance of the jewelry.

Customers with metal sensitivities or allergies should contact us before ordering. We cannot guarantee that every product will be suitable for every individual sensitivity unless expressly stated.

4. Prices, Currency and Taxes

Product prices are displayed in the currency selected or shown on the website.

Prices may change without notice, but a price change will not affect an order that we have already accepted.

The amount shown at checkout may include or exclude taxes depending on the destination, applicable laws, and checkout configuration.

International customers may be responsible for:

• Import duties;
• Customs charges;
• Local taxes;
• Brokerage or handling fees; and
• Other charges imposed by the destination country.

Unless checkout expressly states that these charges have been prepaid, they are the customer’s responsibility.

5. Orders and Order Acceptance

Submitting an order does not automatically mean that we have accepted it.

After an order is submitted, you may receive an automatic confirmation. This confirms that we received the order request but does not necessarily constitute final acceptance.

We may reject or cancel an order when reasonably necessary, including where:

• The product is unavailable;
• The price or product information contains an obvious error;
• Payment cannot be authorized;
• Fraud or unauthorized activity is suspected;
• Shipping to the destination is unavailable;
• The customization request cannot reasonably be produced; or
• The order would violate applicable law or our policies.

If we cancel an order after payment has been received, we will refund the applicable amount using the original payment method.

We will not cancel an accepted consumer order without a lawful or reasonable basis.

6. Payments

Payments are processed through Shopify and available third-party payment providers.

By providing payment information, you confirm that:

• The information is accurate;
• You are authorized to use the selected payment method; and
• You authorize the applicable charges associated with your order.

We do not normally receive or store complete payment-card details.

7. Customized and Personalized Products

Customized products may include products made or altered according to information supplied by the customer, including:

• Names or initials;
• Dates;
• Engravings;
• Symbols;
• Sizes;
• Photographs;
• Handwriting;
• Artwork;
• Tattoos;
• Design instructions; or
• Other personalized elements.

You are responsible for reviewing all spelling, dates, measurements, symbols, and customization instructions before submitting your order.

Production may begin soon after an order is confirmed. Once production has started, a customized order may not be changed or canceled unless we agree otherwise or applicable law requires it.

Personalized or made-to-order products may be excluded from voluntary returns or statutory withdrawal rights where permitted by law. This does not affect your rights if an item is defective, damaged, materially different from what was ordered, or otherwise non-conforming.

By submitting artwork, photographs, text, or other materials, you confirm that you own them or have permission to use them. You authorize us and our production partners to use those materials only as reasonably necessary to process and produce your order.

8. Shipping and Delivery

Shipping times displayed on the website are estimates and are not guaranteed delivery dates unless expressly stated.

Orders may be affected by:

• Production times;
• Customs inspections;
• Carrier delays;
• Severe weather;
• Public holidays;
• Incorrect addresses;
• Local delivery restrictions; or
• Events outside our reasonable control.

Customers must provide a complete and accurate delivery address. We are not responsible for delays or additional costs caused by incorrect or incomplete information supplied by the customer.

Customers should review tracking information and contact us promptly if a shipment appears delayed, damaged, lost, or incorrectly delivered.

9. Returns, Cancellations and Refunds

Returns, cancellations, exchanges, and refunds are governed by our Refund and Return Policy, together with any mandatory consumer rights applicable in the customer’s country.

Returned products must normally be unworn, unused, undamaged, and returned with their original packaging unless:

• The product is faulty;
• The product was damaged during delivery;
• The wrong product was supplied; or
• Applicable law provides otherwise.

Products showing wear, misuse, modification, accidental damage, or failure to follow reasonable care instructions may not qualify for a voluntary return.

Any restriction concerning customized products does not remove legal rights relating to defective, damaged, or incorrectly supplied goods.

EU consumers generally receive statutory protections for online purchases, including withdrawal rights subject to exceptions such as genuinely personalized goods. Mandatory local rights should be reflected in the separate return policy and checkout information.

10. Promotions and Discount Codes

Promotions and discount codes:

• Must be used according to their stated conditions;
• Cannot normally be combined unless expressly permitted;
• Cannot be exchanged for cash;
• May have an expiration date; and
• May be limited to particular products, customers, or regions.

We may cancel a promotion or refuse misuse of a discount where reasonably necessary, but this will not affect orders already lawfully accepted unless fraud or an obvious error is involved.

11. Customer Accounts

You may be able to create a customer account through our website.

You are responsible for:

• Providing accurate account information;
• Keeping your login credentials confidential;
• Restricting unauthorized access to your account; and
• Informing us promptly of suspected unauthorized activity.

We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, enforce these Terms, or comply with legal obligations.

The Salem&Co name, branding, product designs, photographs, graphics, written content, logos, videos, website layout, and other original materials are owned by or licensed to Salem&Co and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping purposes.

You may not, without written permission:

• Copy or reproduce our product photographs or descriptions;
• Republish website content;
• Manufacture products based on our original designs;
• Use our branding to suggest an affiliation with Salem&Co;
• Scrape or systematically collect website content; or
• Exploit our intellectual property commercially.

13. Reviews and Customer Content

When you submit a review, photograph, testimonial, or other content, you confirm that the content:

• Is accurate and based on your genuine experience;
• Does not infringe another person’s rights;
• Is not unlawful, threatening, discriminatory, defamatory, or misleading; and
• Does not contain malicious code or unauthorized advertising.

You retain ownership of your content but grant Salem&Co a non-exclusive, worldwide, royalty-free right to display, reproduce, and use it for operating and promoting our business, subject to applicable privacy law.

We will not use private customization photographs or personal materials for advertising without appropriate permission.

14. Prohibited Uses

You may not use the website:

• For unlawful or fraudulent activity;
• To interfere with the website’s operation or security;
• To introduce viruses or malicious code;
• To impersonate another person;
• To collect information about other users without authorization;
• To place fraudulent orders;
• To infringe intellectual-property or privacy rights; or
• To violate applicable laws or regulations.

15. Third-Party Services and Links

Our website may contain services or links operated by third parties, including Shopify, payment providers, social media platforms, and shipping companies.

We are not responsible for independent third-party websites, content, or services. Your use of those services may be governed by their own terms and privacy policies.

16. Availability of the Website

We aim to keep the website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend or modify parts of the website for maintenance, security, technical, legal, or operational reasons.

17. Disclaimer and Limitation of Liability

Products and Services are provided subject to all warranties and protections that cannot legally be excluded.

To the maximum extent permitted by applicable law, Salem&Co is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

• Fraud or fraudulent misrepresentation;
• Intentional misconduct or gross negligence where applicable;
• Death or personal injury caused by negligence; or
• Mandatory consumer rights and product-conformity obligations.

18. Events Outside Our Control

We are not responsible for delays or failure caused by circumstances outside our reasonable control, such as natural disasters, transportation disruption, customs action, war, civil unrest, government restrictions, widespread service outages, labor disruption, or severe weather.

We will make reasonable efforts to communicate with affected customers and fulfill or resolve affected orders.

Our collection and use of personal information are explained in our Privacy Policy.

By using the Services, you acknowledge that your information may be processed by Shopify, payment providers, shipping providers, and other service providers as described in that policy.

20. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye.

However, if you are a consumer living in another country, this choice of law does not remove any mandatory protections provided by the laws of your country of residence.

Customers should first contact us so we can attempt to resolve any concern directly.

Disputes may be submitted to the competent consumer arbitration committee, consumer court, court, regulator, or other authority as determined by applicable law.

21. Changes to These Terms

We may update these Terms to reflect changes in our products, Services, business practices, or legal obligations.

The revised version will be posted on this page with an updated date. Changes will not normally apply retroactively to orders already accepted unless required by law or agreed with the customer.

22. General Provisions

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure to enforce a provision immediately does not waive our right to enforce it later.

These Terms, together with the policies referenced in them and the information presented during checkout, form the agreement relating to your use of the Services and purchases from Salem&Co.
